Terms of Use

Effective date: September 29, 2026

Evolved Cyber Academy (“Academy”) is operated by Evolved Cyber, LLC (“Evolved Cyber,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your use of the Academy website, your account, and any courses, training sessions, downloads, or related services we provide.

By creating an account, enrolling in a course, making a purchase, or using the Academy website, you agree to these Terms. If you purchase training for someone else or enroll through an employer, the individual learner must also follow these Terms.

1. Educational purpose

Academy courses provide education and practical guidance. Course content does not constitute legal advice, an assessment finding, a certification decision, or a guarantee that an organization will meet CMMC, NIST, contractual, or other requirements.

Requirements and program guidance may change. You are responsible for checking the requirements applicable to your organization and for making your own implementation and compliance decisions. When appropriate, obtain advice specific to your circumstances from qualified professionals.

2. Accounts and enrollment

You agree to provide accurate information when registering and to keep your account information current. You are responsible for activity under your account and for protecting your login credentials. Notify us at [email protected] if you believe your account has been used without authorization.

An individual enrollment is for the named learner. You may not share your login, transfer your enrollment, or give another person access to a course unless we expressly permit it. Organizational or group purchases may be governed by separate written terms.

You must be at least 18 years old to create an Academy account or enroll without the involvement of a parent or legal guardian.

3. Course access and changes

The course description and checkout page identify what is included in an enrollment. Access to a self-paced course lasts 12 months from enrollment, unless a different period is stated on the course page or in a written agreement.

We may update lessons, instructors, schedules, materials, and platform features to keep training useful and current. If we discontinue a purchased course or make a material change that substantially reduces what you purchased during your stated access period, contact us so we can provide an appropriate remedy.

Live training dates, attendance requirements, and any applicable prerequisites will be stated in the course listing or registration information. We may reschedule a live session when reasonably necessary and will communicate the available options to affected learners.

4. Prices, payment, cancellations, and refunds

Prices, applicable taxes, and payment terms are shown at checkout or in a written agreement. Your order is subject to successful payment. A discount or promotional offer applies only according to its stated terms.

Refund and Course Credit Policy

Evolved Cyber Academy courses are generally nonrefundable once purchased. We understand that plans can change, however, and may offer a course credit that can be applied to another Evolved Cyber Academy class.

Self-paced courses

If you purchased a self-paced course and have not substantially accessed its content, contact us within 14 days of purchase to request a course credit. We review requests individually. A credit is not guaranteed after substantial course use or completion.

Live classes

If you cannot attend a live class, contact us at least 7 calendar days before the class begins. We may transfer your enrollment to a future offering or issue a credit toward another Evolved Cyber Academy class. Requests made less than 7 days before the class begins, and failure to attend without notice, are generally ineligible for a credit.

Using a course credit

An approved credit equals the amount paid for the unused enrollment, excluding any nonrefundable third-party charges disclosed at purchase. It may be applied to an eligible Evolved Cyber Academy class within 12 months of issuance. If the new class costs more, you pay the difference. Credits have no cash value and are not transferable unless we approve a transfer in writing.

If we cancel a class

If Evolved Cyber Academy cancels a live class and you do not wish to move to a new date or use a course credit, we will refund the amount you paid for that class.

To request a credit or discuss a purchase, email [email protected] with your name, course title, and order information. This policy does not limit any refund rights required by applicable law.

The refund and cancellation terms presented for a particular course at checkout or in a signed agreement will control if they differ from the general policy above. Nothing in these Terms limits a right or remedy that cannot legally be waived.

5. Permitted use of course materials

Evolved Cyber and its licensors retain their rights in the Academy website and course materials, including videos, slides, narration, workbooks, templates, graphics, quizzes, and written content.

During your authorized access period, we grant you a limited, personal, nonexclusive, nontransferable license to view course content and to download and use materials expressly made available for download for your own learning and your organization’s internal work, subject to any instructions accompanying a particular resource.

Unless we give written permission, you may not:

You may refer to what you learn in your professional work. This section governs use of our materials, not your general knowledge or skills.

6. Learner submissions and conduct

If a course allows comments, discussions, assignments, surveys, or file submissions, you remain responsible for what you submit. You grant us permission to use those submissions as reasonably needed to deliver the course, provide feedback, administer the Academy, and maintain records, consistent with our Privacy Policy.

Do not submit Controlled Unclassified Information (CUI), client confidential information, passwords, security evidence, or other sensitive material through course features or support channels unless Evolved Cyber has expressly approved a secure method for that submission.

You agree to treat instructors and other learners professionally. You may not post unlawful, infringing, harassing, deceptive, or harmful content; interfere with the site; attempt unauthorized access; or misuse another person’s information. We may remove content or restrict access when reasonably necessary to address a violation.

7. Certificates and credentials

A course completion certificate, if offered, indicates that the learner met the Academy’s stated completion requirements. It does not itself confer a professional credential, authorize the learner to act as an assessor, or guarantee eligibility for an external examination or certification. Any external credentialing body sets its own requirements.

We may correct a certificate or completion record issued in error or obtained through account sharing, misrepresentation, or other misuse.

8. Third-party services and links

The Academy uses third-party services, including Thinkific, to operate the course site and may link to external resources. Third-party services may have their own terms and privacy policies. We are not responsible for the content or availability of websites we do not control.

9. Privacy

Our collection and use of personal information are described in the Evolved Cyber Academy Privacy Policy at [insert Privacy Policy URL].

10. Availability and disclaimers

We work to keep the Academy available and its content accurate, but temporary interruptions, technical issues, and outdated material can occur. To the extent permitted by law, the website and course content are provided without a warranty that access will be uninterrupted or that the content will meet every learner’s particular purpose.

We do not guarantee an examination result, certification outcome, contract award, assessment result, or finding of compliance.

11. Limitation of liability

To the extent permitted by applicable law, Evolved Cyber will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Academy. To the extent permitted by law, our total liability for a claim relating to a purchased course will not exceed the amount paid to us for that course.

These limits do not apply where applicable law prohibits them or to liability that cannot legally be limited.

12. Suspension or termination

We may suspend or end access if you materially violate these Terms, misuse the platform or materials, or create a security risk. When practical, we will provide notice and an opportunity to resolve the issue. Ending access does not affect payment obligations already incurred or provisions that reasonably continue after access ends, including intellectual property and limitations of liability.

You may stop using the Academy at any time. Stopping use does not by itself create a right to a refund; the applicable refund policy governs.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new effective date and provide additional notice for material changes when appropriate. Changes will apply prospectively unless a change is required by law or you agree otherwise. The terms presented when you purchased a course will continue to govern material purchase terms such as its price, stated access period, and refund eligibility.

14. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules, except where applicable consumer law requires otherwise. Before filing a claim, you may contact us at [support email] so we can attempt to resolve the concern.
